Terms of Service
TOS apply to Mantor's clients
This TOS applies automatically to all Mantor Organization clients upon activation of the service. By using mantor's services you agree to the policies in this document and to comply with those rules.
Severability and reformation
If any section of this agreement is determined to be or becomes unenforceable or illegal, such section will be reformed to the minimum extent necessary in order for this agreement to remain in effect in accordance with its terms as modified by such reformation.
Applicable law and jurisdiction
This agreement is governed by the provincial laws of Québec and federal laws of Canada. Any disputes shall be submitted to the courts of Québec and the district of Montréal.
Responsibility for content
The client is solely responsible for what is provide by the content stored on and served by his services.
Changes
With 30 days or greater written notice prior to the end of the initial commitment, Mantor Organization may modify any applicable fees under this agreement.
Payment obligation
The client must pay its account even if he is not making any use of it.
Late payment
Service will be interrupted on past due accounts after a 48 hours notification. When service has been interrupted for nonpayment a $30 fee will be charged. Unless specified otherwise, any payment not made when due will be subject to interest of 3% per month compounded monthly (equivalent to yearly interest rate of 26.86%). Bounced checks are subject to a penalty fees of $30. Invoice that are in sufferance for more then 1 month may be turned over to an outside collection agency. In that case, you agree to pay a "processing and collection" fee of up to 30%.
Billing and termination
Invoices are sent by email and displayed via our website. On request a copy can be sent by mail. Mantor Organization reserved the right to terminate the service at any moment without prior notice.
Privacy
Mantor Organization will not provide any client's personal information to third party except if needed in order to collect fees owed or required by laws. Disclosure of such information to any third party will be made by Mantor Organization only if required by law as evidence by an order of a court of competent jurisdiction and to collection services if needed. The client authorizes Mantor to use it's name, business name and comments in marketing documents. However, at any time, the client can send a written notice to withdraw this authorization.
Force Majeur
Neither party can be held liable if he fails to comply to it's obligations due to a Force Majeure. A Force Majeure is an inescapable event of such nature that the performance of an obligation is totally impossible.
